Terms of Use

These Terms & Conditions (“Terms”) govern your access to and use of www.ascentroofingsd.com (the “Site”) and any products, services, content, estimates, or communications offered by Ascent Roofing (a California corporation, CSLB License No. 1030774 (C-39 Roofing)) (“Ascent Roofing,” “we,” “us,” or “our”) (collectively, the “Services”). Please read them carefully.

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Services.

These Terms govern your use of this website. They do not replace, modify, or limit any signed written contract, proposal, or warranty between you and Ascent Roofing for roofing work. If a signed contract conflicts with these Terms, the signed contract controls as to that work.

1. Eligibility & Acceptance

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Changes to These Terms

We may modify these Terms at any time. Revised Terms become effective when posted, and we will update the “Last Updated” date above. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.

3. Permitted Use & Prohibited Conduct

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes in accordance with these Terms. You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Violate any applicable law, regulation, or third-party right;
  • Copy, reproduce, scrape, harvest, or republish any part of the Services without authorization;
  • Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to our systems;
  • Interfere with or disrupt the integrity, security, or performance of the Services;
  • Use automated means (bots, crawlers) except as permitted by our robots.txt;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Submit false, misleading, or fraudulent estimate, inspection, or warranty requests;
  • Use the Services to transmit unsolicited or unauthorized advertising or spam.

4. Licensing & Contractor Information

Ascent Roofing is a licensed roofing contractor in the State of California, a California corporation, CSLB License No. 1030774 (C-39 Roofing). Information about the license, including its status, classification, bonding, and workers’ compensation coverage, can be verified with the California Contractors State License Board (CSLB) at www.cslb.ca.gov or by calling 1-800-321-CSLB (2752). Contractors are required by law to be licensed and regulated by the CSLB, which has jurisdiction over complaints against contractors. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, CA 95826.

We perform work only within the service areas described on the Site and only under the license classifications we hold. Nothing on the Site is an offer to perform work outside those areas or classifications.

5. Estimates, Quotes & Scheduling

Requesting an estimate, inspection, or appointment through the Site is a request only — it does not create a contract and does not obligate either party until we deliver a written proposal and you accept it in writing. Estimates and quotes are:

  • Preliminary until confirmed on site. Any figure produced without a physical inspection is an approximation. Actual scope and price may change once the roof is inspected or once concealed conditions (such as deteriorated decking, dry rot, or code-required upgrades) are discovered.
  • Time-limited. Quoted pricing is valid only for the period stated on the written proposal and is subject to change based on material costs, permit requirements, and availability.
  • Subject to change orders. Additional or changed work will be documented and priced in a written change order before it is performed, as required by California law.

Appointment windows, crew arrival times, and project timelines are estimates and may be affected by weather, permitting, inspections, material lead times, and other conditions outside our reasonable control.

6. Pricing, Payment & Financing

Descriptions, pricing, and availability of products or services shown on the Site are for general information, are subject to change without notice, and are not an offer. We strive for accuracy but do not warrant that descriptions, pricing, or other content are error-free. We reserve the right to refuse or cancel any request, correct pricing errors, and decline projects at our discretion.

Payment terms, deposits, and progress-payment schedules for actual work are governed exclusively by your signed written contract and by California law, including the limits California places on down payments for home-improvement contracts. Financing options referenced on the Site are offered by independent third-party lenders, not by Ascent Roofing. We do not make credit decisions, and approval, rates, and terms are determined solely by the lender under its own agreements and privacy policy.

7. Warranties

Any workmanship warranty we provide, and any manufacturer warranty on materials, is set out in the written documents delivered with your project. Warranty terms, coverage, exclusions, duration, and transferability vary by product and by project. Statements on this Site are general marketing descriptions and do not create, extend, or modify any warranty. Manufacturer warranties are provided by the manufacturer, not by Ascent Roofing, and are subject to the manufacturer’s own terms, registration requirements, and claims process.

8. Intellectual Property

The Services and all content, features, and functionality — including text, graphics, logos, images, project photography, designs, software, and trademarks — are owned by or licensed to Ascent Roofing and are protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except for the limited license granted in these Terms, no rights are transferred to you. You may not use our name, logos, or trademarks without our prior written consent. 9. User Content & Submissions

If you submit reviews, comments, photos, or other content (“User Content”), you retain ownership but grant Ascent Roofing a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, display, and distribute that User Content in connection with the Services and our business. You represent that you own or control all rights to your User Content, that you have permission from any person or property owner shown in it, and that it does not violate these Terms or any third-party right. We may remove User Content at any time for any reason.

10. Third-Party Links & Services

The Services may contain links to or integrations with third-party websites, products, or services that we do not control, including video players, mapping services, review platforms, financing partners, and manufacturer sites. We provide these for convenience only and do not endorse and are not responsible for their content, policies, or practices.

11. Disclaimers of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, Ascent Roofing DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

CONTENT ON THE SITE — INCLUDING ARTICLES, GUIDES, MAINTENANCE TIPS, COST RANGES, AND ROOFING-SYSTEM DESCRIPTIONS — IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY. IT IS NOT ENGINEERING, STRUCTURAL, CODE-COMPLIANCE, INSURANCE, LEGAL, OR TAX ADVICE, AND IT IS NOT A SUBSTITUTE FOR AN ON-SITE INSPECTION OF YOUR SPECIFIC PROPERTY BY A QUALIFIED PROFESSIONAL. 12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Ascent Roofing OR ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL CUMULATIVE LIABILITY ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THIS SECTION LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR PERSONAL INJURY, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER CALIFORNIA LAW. 13. Indemnification

You agree to indemnify, defend, and hold harmless Ascent Roofing and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your User Content, or your violation of these Terms or any law or third-party right.

14. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 15, you agree that any dispute arising from your use of the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction and venue there.

15. Dispute Resolution

Before filing any claim, you agree to first contact us at office@ascentroofingsd.com and attempt to resolve the dispute informally. We will do the same. Most disputes can be resolved this way.

If a dispute cannot be resolved informally, the parties may agree in writing to submit it to binding individual arbitration or mediation. Either party may bring a qualifying claim in small-claims court. Disputes concerning roofing work we performed are governed by the dispute-resolution provisions of the signed contract for that work and by California law, including your rights before the Contractors State License Board, which are not waived by these Terms.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.

17. Miscellaneous

  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding your use of the Site.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
  • No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our consent; we may assign them freely.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including weather, fire, labor or material shortages, permitting delays, and acts of government.
  • Headings. Section headings are for convenience only and have no legal effect.
